General Terms of Service and Licence to Use

EFEIGHT.com provides professional real-estate, architectural, commercial and corporate content-creation services. These terms govern the booking, performance, delivery and use of the services and materials supplied by EFEIGHT.com.
By booking any service, the client accepts the version of these terms made available before the booking, when accepting a quotation or when confirming the appointment.

2. Purpose and scope
These terms govern professional photography, video, aerial imagery, virtual tours, 360° content, floor plans, infographics, renders, digital editing, retouching, promotional material and related services.
They apply to private clients, estate agencies, developers, architects, interior designers, companies and other clients unless a quotation or contract contains specific terms. Where there is a conflict, the specific terms shall prevail only in relation to the points expressly amended.
3. Pre-contract information and acceptance
Before the service is provided or when the appointment is confirmed, EFEIGHT.com will provide sufficient information about the assignment, its scope, price or pricing criteria, payment method, delivery and access to these terms.
Acceptance may be evidenced through an online booking, acceptance of a quotation, written confirmation of the appointment, full or partial payment, or any other unequivocal conduct showing an intention to contract after access to these terms has been provided.
A delivery email may remind the client of the applicable licence, but it shall not be used as the sole basis of the contractual relationship where these terms were not communicated beforehand.
4. Definitions
Material: any work, file or content created, captured, edited, rendered, processed or delivered by EFEIGHT.com in connection with the assignment.
Final files: exported versions prepared for the agreed use, usually in formats such as JPG, PNG, PDF, MP4 or other distribution formats.
Source files: originals or working files such as RAW, NEF, PSD, layered TIFF, video projects, CAD files, 3D models, catalogues, masks, LUTs, presets, templates or editable elements.
Property or project: the property, development, establishment, space, work, product or assignment identified in the booking, quotation, invoice, email or delivery.
Authorised collaborators: persons or entities legitimately involved in the same commercial operation, such as agencies, agents, portals, developers, lawyers, home stagers, marketing companies or technical providers.
5. Formation and scope of the assignment
The scope of the work shall be the one described in the booking, quotation, order or confirmed communication. Any service not expressly included shall be treated as additional work and may be quoted separately.
The number of photographs, video duration, number of plans, 360° positions, revisions, resolution, formats and delivery times may vary reasonably where they depend on the property, access conditions, weather, legal restrictions, third-party availability or justified technical and creative decisions.
6. Client obligations and property preparation
The client guarantees lawful access to the property and that sufficient authorisation has been obtained from the owner, occupier or person responsible for the areas included in the assignment.
The property must be clean, tidy, accessible and ready for the shoot. Unless expressly booked, EFEIGHT.com does not provide cleaning, removal, decoration, gardening, repair or extensive furniture-rearrangement services.
The client must give prior notice of risks, restrictions, alarms, animals, building work, private areas, sensitive items, persons who must not appear and any circumstance relevant to the safety or legality of the work.
Delays, waiting time, additional travel or extra work caused by inadequate preparation, incorrect access or incomplete information may be charged separately.
7. Date, access, cancellation and rescheduling
The date and time shall be considered confirmed when expressly communicated by EFEIGHT.com. The client must provide timely access and a contact person where necessary.
The cancellation or rescheduling terms stated in the booking or quotation shall apply. If no specific term has been stated, EFEIGHT.com may charge expenses actually incurred, travel already undertaken and reserved time where a cancellation is late or the service cannot be performed for reasons attributable to the client.
Drone, exterior, view or natural-light services may be rescheduled where weather, airspace restrictions, safety, permits or technical conditions prevent a reasonable result or lawful operation.
8. Price, taxes and payment
Prices shall be those shown in the booking or quotation and shall be increased by the taxes legally applicable. Travel, permits, fees, parking, subsistence, accommodation, music, third-party licences, hosting, urgent work and additional services are included only where expressly stated.
Unless otherwise agreed, the licence to use the material becomes fully effective once the full price has been paid. Until then, any provisional delivery, proof or preview is supplied for review only and does not authorise publication, distribution or commercial exploitation.
Non-payment may result in the suspension of deliveries, links, hosting, publication of tours or recurring services, without prejudice to the recovery of any outstanding amount.
9. Professional performance and creative judgement
EFEIGHT.com shall perform the assignment with professional care and apply its technical and creative judgement to framing, lenses, exposure, lighting, colour, selection, editing, pace, music, composition, route, order and final format.
References supplied by the client are for guidance only and do not require exact reproduction of the styles, lighting conditions, views or results of other authors or properties.
10. Selection, editing and visual accuracy
EFEIGHT.com shall select technically suitable material and may discard duplicate, blurred, test or unsuitable shots, images involving safety issues or images that do not add value to the final result.
Editing may include corrections to perspective, colour, exposure, contrast, reflections, small imperfections, temporary elements, sky, screens, windows, grass, lighting and composition, within the agreed scope and without any obligation to carry out structural or misleading alterations.
Renders, reconstructions, replacements, virtual staging or substantial alterations must be identified or used in a way that does not mislead viewers regarding essential features of the property where required by law or good commercial practice.
11. Delivery, formats and timescales
Delivery may be made by download link, online platform, email, cloud storage or another agreed method. The client must check receipt, download the files and report technical issues within a reasonable period.
Delivery times are estimates unless expressly agreed as essential. They may vary due to workload, complexity, revisions, weather, technical incidents, external providers or force majeure.
Download links may remain active for a limited period. The client is responsible for downloading and keeping secure copies of the material after delivery.
12. Revisions and corrections
The revisions included shall be those stated in the booked service. Where none are stated, one reasonable round of corrections for objective errors or minor adjustments shall be included, provided the request is grouped and made within seven calendar days of delivery.
Changes of opinion, new instructions, music replacement, re-recording, additional visits, complex alterations, advanced retouching, mass removal of objects or persons, or adaptation for unforeseen uses are not included corrections and may be quoted separately.
13. Authorship and intellectual property
Authorship and intellectual-property rights in the original material created by EFEIGHT.com remain with the professional owner of EFEIGHT.com unless expressly assigned in writing.
Payment covers production of the assignment and the licence defined in these terms; it does not constitute a sale of authorship, a full transfer of rights, delivery of source files or waiver of moral rights.
Where the assignment incorporates music, typefaces, plans, brands, images, models, software or other third-party resources, their use is also subject to the licences and restrictions of their respective owners.
14. Licence granted to the client
Once the service has been paid in full, EFEIGHT.com grants the client a non-exclusive, limited licence restricted to the property, project and purpose for which the assignment was created.
Within that purpose, the licence authorises reproduction, publication, distribution and communication of the material through real-estate portals, websites, social media, presentations, advertisements, shop windows, brochures, internal platforms, print media and campaigns promoting the same property or project.
The licence is not exclusive unless expressly agreed. It does not authorise resale products, stock libraries, templates, courses, databases, artificial-intelligence models or other assets independent of the assignment.
15. Sharing with authorised collaborators
The client may provide copies of the material to authorised collaborators involved in the same operation and for the same purpose. This does not constitute a general sublicence and does not grant those collaborators independent rights.
The client should ensure that collaborators understand and respect the usage restrictions. The end of the relationship between the client and a collaborator does not authorise that collaborator to reuse the material for other properties, campaigns or projects.
A change of agency, agent, portal, developer or marketing provider does not require a new licence where the material continues to be used solely for the same property, operation and purpose, unless exclusivity or a specific limitation has been agreed.
16. Uses requiring additional authorisation
Express authorisation or a new agreement is required for, among other things: use for another property or development; general corporate campaigns unrelated to the assignment; third-party advertising; resale or sublicensing; merchandising; stock libraries; competitions; editorial publications; television or film exploitation; supply to providers for their own portfolios; political use; or any use substantially different from the agreed purpose.
Authorisation is also required for modifications that misrepresent authorship, fraudulently remove watermarks or identifying metadata, distort the meaning of the work or may damage the professional reputation of the author.
17. Source files, originals and unselected material
Source files and unselected material are not included in the delivery unless expressly agreed and separately priced. EFEIGHT.com is not required to keep them indefinitely or provide layers, masks, catalogues, presets, projects, processes or working methods.
Where a source file is exceptionally supplied, this does not transfer intellectual property or authorise extraction of reusable resources, templates, techniques or elements beyond the agreed project.
18. Virtual tours, hosting and recurring services
Virtual tours, galleries, pages, hosted videos, maps, domains, storage or third-party integrations may depend on recurring services, licences, fees or external infrastructure.
Initial delivery does not imply indefinite hosting. The included term, renewal price and consequences of non-renewal shall be those stated for the service. In the event of non-payment, provider discontinuation or technical impossibility, EFEIGHT.com may disable hosting after giving the client reasonable notice.
EFEIGHT.com cannot guarantee uninterrupted continuity of third-party platforms, although it will take reasonable steps to manage issues within its control.
19. Drones, permits and operational restrictions
Aerial operations are subject to applicable law, UAS geographical zones, permissions, coordination, weather, visibility, safety, privacy, presence of persons, temporary restrictions and the characteristics of the location.
Booking aerial imagery does not guarantee that the flight can take place on the planned date or from a particular height, position or route. Where necessary, EFEIGHT.com may offer rescheduling, a technical alternative or a refund of the unperformed part, depending on the circumstances and the applicable agreement.
20. Floor plans, measurements, renders and technical information
Unless expressly stated otherwise, floor plans, sketches, areas, measurements, diagrams and renders are produced for visual, informative or commercial purposes and do not replace surveys, technical projects, certificates, valuations, land-registry documentation or measurements by qualified professionals.
The client must verify technical or legal data before publication or contractual use. EFEIGHT.com is not responsible for errors arising from information, plans, measurements or instructions supplied by the client or third parties.
21. People, objects, brands and third-party rights
The client must state whether identifiable persons are to appear and obtain any necessary image permissions. EFEIGHT.com may refuse to capture or publish content where there are reasonable concerns about rights, privacy, minors, safety or legality.
The client guarantees that any materials, logos, texts, plans, music, photographs, brands or instructions supplied for the assignment may be lawfully used and shall indemnify EFEIGHT.com against claims arising from unauthorised content, except to the extent caused by EFEIGHT.com.
22. Artificial intelligence and automated processing
EFEIGHT.com may use assisted-editing, automation or artificial-intelligence tools as part of its workflow, always under professional judgement and with appropriate attention to confidentiality and security.
Unless expressly authorised, the client and its collaborators may not use the delivered material to train, fine-tune, test or supply artificial-intelligence models, create datasets, generate substitute imitations of the author or commercially exploit derived styles or assets outside the agreed purpose.
This restriction is contractual and does not affect uses that cannot lawfully be excluded.
23. Portfolio, self-promotion and confidentiality
Unless confidentiality has been agreed or the client has communicated a legitimate reason, EFEIGHT.com may display the material in its portfolio, website, social media, presentations, awards, professional samples and promotional communications once the property or project is public or where publication does not cause unreasonable harm.
Any confidentiality requirement, temporary embargo, location anonymisation or prohibition on portfolio use must be agreed in writing before the service is performed.
24. Retention, backups and archiving
EFEIGHT.com may keep copies of final and working material for a reasonable period for operational, legal, security, portfolio or rights-enforcement purposes, without accepting a permanent archiving obligation.
The client must maintain its own backups. Recovery, re-export or redelivery after the ordinary period may depend on availability and may incur an additional fee.
25. Liability and reasonable limitations
EFEIGHT.com is liable for direct loss caused by wilful misconduct, gross negligence or attributable contractual breach, within the limits permitted by applicable law.
It is not responsible for indirect loss, expectations of sale, portal positioning, third-party commercial decisions, algorithm changes, platform outages or marketing results that do not depend exclusively on the creative service.
Nothing in these terms limits non-waivable consumer rights or liabilities that cannot legally be excluded or restricted.
Where the client acts in the course of business or profession, and except in cases of wilful misconduct or gross negligence, EFEIGHT.com’s total financial liability in connection with an assignment shall not exceed the amount actually paid for that assignment, unless mandatory law provides otherwise.
26. Breach of the licence
Use outside the authorised scope may lead to suspension of the licence, withdrawal of links, a cease-and-desist request, financial regularisation, invoicing of an additional licence and any legal action available.
Before taking disproportionate measures, EFEIGHT.com will, where reasonable, notify the client and offer an opportunity to correct or regularise the use.
27. Personal data protection
EFEIGHT.com processes contact, billing, booking, property, communication and service data in order to manage the contractual relationship, comply with legal obligations, respond to enquiries, prevent fraud and protect rights.
The Privacy Policy may be consulted at www.efeight.com. Data necessary to perform the contract is processed on the basis of the contractual relationship and compliance with legal obligations. Consent is used only where appropriate and may be withdrawn without affecting the lawfulness of earlier processing.
28. Marketing communications
Promotional emails and other electronic marketing communications shall be sent in accordance with applicable law.
Where the recipient has expressly authorised them, EFEIGHT.com may provide information about promotions, news, new services and offers that may be of interest. Consent shall be requested through a separate, clear, voluntary and unticked option.
Where there is an existing contractual relationship, EFEIGHT.com may send communications about its own similar products or services where the legal requirements are met. Every message shall include a simple and free way to object or unsubscribe.
29. Terms applying to consumers
Where the client qualifies as a consumer, all mandatory rights shall be respected, including pre-contract information, transparency, guarantees, distance-contract rules and, where applicable, the right of withdrawal.
If the service is to begin during the withdrawal period, the consumer’s express request will be obtained and the legal consequences for work already performed, and where applicable the loss of the right once the service has been fully completed with prior consent, will be explained.
Jurisdiction, liability, cancellation and acceptance clauses shall be interpreted consistently with mandatory consumer law.
30. Duration and termination of the licence
The licence remains in force while the material is used for the lawful marketing of the property or project, unless a specific term applies.
Removal of the property from the market does not require deletion of lawful historical publications, internal archives or campaign records, but it does not authorise new unrelated uses.
EFEIGHT.com may terminate or suspend the licence for non-payment or serious breach, subject to reasonable prior notice where possible. Termination does not affect accrued rights, confidentiality, intellectual-property, data-protection or outstanding claims.
31. Updates, versioning and evidence
Each version of these terms shall be identified by number and date. EFEIGHT.com may retain evidence of the version communicated to or accepted by each client, together with the date, job reference and means of acceptance.
Later amendments shall not apply retroactively to existing assignments unless accepted by the client or required by mandatory law. The applicable version is the one communicated before the contract was made or expressly agreed for the assignment.
32. Severability, interpretation and precedence
If any clause is declared void, invalid or unenforceable, it shall be interpreted or replaced only to the minimum extent required, and the remaining clauses shall continue in force.
Headings are for convenience and do not limit meaning. In the event of conflict, the specific terms accepted for the assignment shall prevail, followed by these general terms and then by operational communications that do not expressly amend them.
33. Governing law, complaints and jurisdiction
These terms are governed by Spanish law. The parties shall attempt to resolve disputes in good faith through direct communication and reasonable negotiation.
Where the client acts as a consumer, the courts determined by mandatory law shall have jurisdiction. Where the client acts in the course of business or profession, the parties submit to the courts of Marbella unless a different mandatory forum applies.
